Rape-homicide complaint vs 11 respondents in Christine Dacera case dismissed

The Makati City Prosecutor’s Office dismissed the rape with homicide complaint against 11 suspects in the death of flight attendant Christine Dacera.

In the resolution issued by Makati City Prosecutor Joan Bolina-Santillan, it is said that the complaint was dismissed due to the lack of probable cause especially since it was not proven that the respondents committed a crime.

It was December 31 when Dacera booked a hotel room at the City Garden Hotel with his friends to celebrate the New Year. In Room 2209, the two had a friendly reception, and they also allegedly had a party with them in the next room, Room 2207.

At dawn, Dacera felt a headache and eventually lost consciousness. Christine Dacera was declared dead when taken to the hospital.

Earlier, the Philippine National Police’s medico-legal report showed that Dacera died of a ruptured aortic aneurysm and there was no homicide in the incident, something the Dacera family denied.

Last month, the respondents in Christine Dacera’s case would be filing counter charges against the family of the deceased flight attendant for allegedly making unfounded claims against them, their lawyer said.

According to Mike Santiago, the legal counsel for five of the 11 respondents, accused the Dacera family of perjury, malicious prosecution, libel, and incriminating innocent persons.
Santiago added his clients were also contemplating seeking moral damages. Perjury charges may also be filed against the witnesses of the Dacera camp, the lawyer added.

“We will also file counter charges against people who are concocting lies one after the other,” Santiago said at a press briefing. “They want to force the issue there was rape with homicide.”

Santiago said it is unlikely that his clients would enter into an amicable settlement.

“They are innocent. There’s nothing to amicably settle. You only settle amicably if you think you’re guilty,” he said.
