Jonel Nuezca given double life sentence for killing mother and son neighbors

Sergeant Jonel Nuezca, the cop who was caught on video shooting his mother and son neighbors dead was given a double life sentence.

The killer cop was also ordered to pay P1 million damages to the victims’ family.

In January, Iligan City Representative Frederick Siao on Tuesday appealed to government prosecutors to not let Jonel Nuezca use “insanity” as his defense for  Sonya and Frank Gregorio to death in December last year.

Siao said it could be expected that the killer cop would push for an insanity defense in court given the fact that he pleaded not guilty to double murder.

He added Nuezca’s lawyers could use eyewitness testimony or present a psychologist or even a pastor to state a compassionate assessment of the dismissed cop’s mental health.

The killer cop recently filed a  plea in the  case filed against him after he was caught on video shooting dead two of his neighbors in Paniqui, Tarlac in December.

According to Attorney of the Philippines,  “Insanity is the best defense for an individual to avoid criminal liability. However, there are some conditions that must be taken into consideration. An insane person under Paragraph 1, Article 1 of the Revised Penal Code of the Philippines, the person is exempt from criminal liability if he or she acted during lucid interval. There should be clear and convincing evidence to prove the defendant’s insanity.”

Nuezca was suspended for 10 days in 2010 for reasons not detailed by the authorities.

In 2013, he faced a grave misconduct case, but it was dismissed due to lack of evidence.

In April 2014, the Tarlac killer cop faced less grave neglect of duty for refusing to take a drug test. Records showed that Nuezca had left the testing area without permission from authorities.

In 2016, he faced serious neglect of duty after failing to attend a court hearing as a prosecution witness of a drug case. The case was dropped and closed.

Last year, Jonel Nuezca again had grave misconduct (homicide) case filed against him. However, it was dismissed due to a lack of substantial evidence.
