Anti-Red Tape Authority to file case vs employees not issuing approved business permits

The Anti-Red Tape Authority will file a complaint against some government employees after some applicants failed to be issued with approved business permits.

Complaints of violations of Republic Act 11032 or the Ease of Doing Business and Efficient Government Service Delivery Act of 2018, will be filed with the Office of the Ombudsman and Civil Service Commission the next day, according to ARTA director-general Jeremiah Belgica.

“Malinaw po ‘yan, a business permit should not go beyond 3 days,” Belgica said in an interview with Teleradyo on Wednesday.

“Kung kumpleto na ang kanilang mga dokumento at nabayaran na po, ‘pag lumagpas ng 3 araw at hindi ‘yan ginagalawan sa kabila na kumpleto na, automatically approved na po ‘yan. ‘Yan ang kagandahan sa batas at marami na po tayong automatic approval. Almost 10,000 permits na po,” he added.

Based on RA 11032, all applications or requests for government service must be given the attention of the assigned officer within 3 working days for simple transactions, 7 working days for complex transactions, and 20 working days for highly technical transactions.

Last year, several agencies and local governments were allegedly charged by ARTA for violating the law.

Belgica also said she is ready to work with the Office of the Presidential Adviser on Streamlining Government Service to Processes formed by President Rodrigo Duterte on Tuesday.

“Napakadami ho kasi talagang dapat ayusin, kaya lahat ng tulong na aming makukuha in any form ay amin pong wine-welcome po ‘yan,” said Belgica.

Although Anti-Red Tape Authority can report directly to Duterte, for him, there is no duplication of the formation of OPASGP.

“Wala pong duplication. Wala po itong sabihin natin na added bureaucracy, pero sabihin natin na strengthening of the team,” said Belgica.

Section 17 of Republic Act 11032 provides for the creation of the Anti-Red Tape Authority or ARTA, the government agency mandated to administer and implement the said law and its Implementing Rules and Regulations, and to monitor and ensure compliance with the national policy on anti-red tape and ease of doing business in the country.
