The judge on Thursday postponed the arraignment of the suspect in the shooting of Philippines Eagle “Matatag” after his legal counsel questioned the legality of the confiscation of his firearm.
Rolando Aparesio, aged 18, was due to be arraigned for the charges on violation of the Comelec gun ban, as well as violation of Republic Act 10591 (the Comprehensive Firearms and Ammunition Regulation Act).
As the arraignment was in session Aparesio’s lawyer questioned the manner by which the firearm was confiscated inside his client’s residence, pointing out the fact that police did not have a search warrant.
The judge in the case ordered the arraignment moved to June 3, until the lawyer can file a motion before the court on the dismissal of the confiscation of the gun.
Baguio District Police arrested the accused after his brother turned up to the station and reported the incident to authorities.
Aparesio is said to have owned up to the shooting of the rare Philippine Eagle after he shot it on February 21 – not long after the eagle was released in the wild by the Philippines Eagle Foundation.
