American to face court after insulting co-worker on Facebook

The Cebu City Prosecutor’s Office has indicted an American after he allegedly posted derogatory statements about his co-worker.

Prosecutors found enough evidence to charge Andre Philippe LaFlamme in violation of Republic Act 10175 (the Cybercrime Prevention Act of 2012).

Prosecutors say that LaFlamme is guilty of online libel after reviewing his Facebook posts between 2014 and 2016.

A P120,000 bail has been set by the court for LaFlamme’s temporary freedom. 

The plaintiff in the case is Quennie Samane, who filed charges of libel against LaFlamme for damaging her good reputation through several Facebook posts.

Both Samane and LaFlamme were co-workers in a BPO firm based in Cebu City.

In Samane’s complaint she accused LaFlamme, the BPO’s senior manager of defamation based on a post by LaFlamme that showed a photograph of her with the heading “I’d do anything for money.”

In April of 2016, LaFlamme once again posted another photograph of Samane with the caption “Revenge is sweet and no fattening. Perhaps, someone we know should have limited their diet to revenge rather than feasting on the fat of other people’s labor.”

Though not part of the hearing process so far, Samane accused LaFlamme of threatening additional employees due to the inability to be loyal to him.

LaFlamme failed to submit a counter-affidavit in his defense, prompting the prosecutor’s office to file a warrant of arrest.

Authorities say that LaFlamme’s postings fall under Article 353 of the Revised Penal Code which pertains to online libel.
